Operating Agreement

Equipment: Lessor shall provide the equipment in good safe working order with a minimum of 1/2 tank of fuel. Equipment shall be toured at delivery for any predelivery damages. Any damages occurring to equipment from equipment failure shall be responsibility of Lessor. Any damages done to equipment due to operator error or misuse shall be responsibility of Lessee.

Operation: Lessee acknowledges and agrees that its operating crew is familiar with the equipment and has received appropriate training is competent and qualified to operate and maintain the equipment in a safe manner. Lessee is liable for its operation.

Safety: Lessee shall be familiar with all related OSHA requirements with operation of equipment and wear all required safety gear. Lessee shall call Diggers Hotline when applicable. Lessee shall be aware of all power lines in operation of equipment and stay away according to local utility companies requirements. Operator shall not operate equipment when general public or family is within range of equipment use. When concern of public safety place fencing or protective barriers. Operator shall not allow children to ride in cab. Operator shall be aware of all septic tanks, mound systems, electrical boxes or cabinets. Be aware of all operational loads and weight requirements of equipment rented. Lessor is not responsible for oil stains or cracked concrete.

Liability: Lessee has sole responsibility for damage to equipment, property and bodily injury occurring from the operation of the equipment during the duration of rental agreement. This includes but not limited to damage to concrete, asphalt or septic systems due to weigh of machine. Staining because of residual fuel and oil leaks. Electrocution due to operating to close to power lines. Tip over due to operating to close to unsecure soils or to steep of inclines.

Indemnification: Lessee shall indemnify, defend and hold harmless Lessor from against any and all damage or injury caused by the Lessee's operation and use of equipment. This includes all loss, damage, cost, expense, penalty, lien, award or judgment, including attorney’s fees and court costs, arising out of or related to any claim, demand, suit, or legal action of any nature made against Lessor.

Insurance Coverage: Lessee is responsible for, and shall procure and maintain at all times while the equipment in in the Lessee’s care, custody and/or control, General Liability, Bodily injury and property damage coverage.

Rental Rates: Shall be what's posted at www.pragerventures.com website the date of this agreement unless negotiated price is established.

Operating Agreement - Dump Trailer

Gross load: The gross weight for the dump trailer is 15,000 pounds the weight of the trailer is 3000 lbs. So the carry weight is 12,000 lbs. Lessee must determine if there hitch and there truck will carry that kind of load.

Hydraulic dump controls: The switch control is in the black storage box and is on a cable with a electric switch. It runs off the battery in that box. If it runs out of power jumper cables can be using to repower the hydraulic motor. If using the dump box multiple days the battery should be recharged.

Hitch: The trailer uses a 2 5/16” ball. The hitch itself should be rated for the load being carried.

Connections: Upon placing the trailer over the ball lower the trailer using the crank jack, make sure the trailer is fully on the ball. Then there is a latch pin that goes fully through the lock latch. Pull the crank jack adjustable pad handle out to raise the pad all the way up as not to catch the pavement. Hook up the electric cable for lights and brakes. Lessee must have a brake controller installed on there truck for the brakes to work. There is a brake away cable that must be hooked up separately to the truck. Chains should be hooked up to the truck so that they do not drag on the ground. Test the brake controller to ensure the brakes work.

Preventive damages: If dumping broken concrete or larger rocks use plywood or a protective mat should be placed on the floor of the dump trailer. to prevent denting. When dumping the rear dump doors should be latched so as to not bind doors. Be careful when dumping over the wood side extensions as not to damage sides.

Damages: Lessee or renter shall be responsible for all damages denting, flat tires, broken wood, damage controls etc.
